Guess I have to answer my own question... From my research if you pay FULL retail, or bring your own hardware to T-Mo no *data plan is needed.
(You can configure Voice thru T-Mo, Data thru Wi-Fi only.)
*Not all functions of phone may function...

AT&T I've read requires a data plan- even if you bring you're own hardware!
Seems that with all the unlimited plans being capped- Carriers wouldn't give you grief about using the phone- data going thru Wi-fi.
I hope T-Mo doesn't merge with them...
Note to greedy carriers, if you bring your own hardware- you should be able to confiqure data to go thru Wifi

Can a unlocked VS750 be used on T-Mobile USA, with the DATA part of the phone via generic Wi-Fi hotspots such as coffeshops, McDonald's and the like with NO DATA PLAN?

Couldn't disagree more. There is nothing wrong with WM6.5 and resistive touchscreens are not inferior - just different. Both are equally useless for a onscreen keyboards and personally I don't care about multitouch at all, because I've got this little thing called a zoom bu-tt-on.
iOS has no redeeming features. Android has some, but is too closely based on the useless iOS interface. WP7 - same problem. WM6.5 is still the most open, powerful and flexible phone OS out there by miles.

I have had both phones,ALLY was real noisy ,Fathom locks up,went back to my lg8360,it works,so I use free wifi @McD's and wait for better phone,maybe w7 phone will rock!,btw the Fathom is much faster than the Ally,but doesnt have as many apps,no where near as many

@p1xMU51c Android still runs pretty quick on a 600Mhz processor... Windows Mobile is an extremely outdated operating system compared to iOS and Android.... most of the applications (notice I said most) on WinMo aren't as good of quality as the ones on Android. And most people today wouldn't care about the technical specifications of a device, and instead would care about if it can play Angry Birds or not... ;)
And not only is the OS not-so-good, it also has a resistive touchscreen... eww... ;)
